Employers must comply with both Australian workplace laws and immigration laws. Like all Australian employees, 457 Visa holders are covered by the Fair Work Act 2009.
The 457 visa is the most commonly used program for employers to sponsor skilled overseas workers to work in Australia temporarily.
The Fair Work Ombudsman and the Department of Immigration and Border Protection (DIBP) both have processes in place to protect employees on 457 Visas from exploitation in the workplace.
Employers that sponsor 457 Visa holders must provide the same terms and conditions as Australian workers performing the same work in the same workplace.
