The Fair Work Commission has issued an update to the Rail Industry Award 2010, which will take effect from the start of the first full pay period starting on or after 1 January 2018.
The updates to the Rail Industry Award 2010 involves a re-wording of a number of clauses, primarily the Overtime and penalty rates and Casual employment clauses. This re-wording has been carried out in order to clarify the position with respect to the payment of the 25% casual loading when overtime and penalty rates are also applicable. The amendment clarifies that in calculating the relevant casual rate, the casual loading and applicable penalty rates are separately calculated by reference to, and then separately added to, the base ordinary rate.
The update takes effect from the start of the first full pay period starting on or after 1 January 2018.
