Changes to the Health Professionals and Support Services Award 2020

The Fair Work Commission has recently clarified the way some Award provisions apply, and made minor amendments to the Health Professionals and Support Services Award 2020.

What Are the Changes?

Effective 18 June 2020, the Fair Work Commission (FWC) has clarified the way some Award provisions apply and made minor amendments to the Award itself.

The FWC has stated in the schedule that full-time and part-time support services employees in 7-day private medical imaging practices are to be paid at 125% of the minimum hourly rate for Saturday work. This 125% penalty rate was removed in July 2019 and replaced with a 150% penalty, and there does not appear to be any reasoning as to why the reduced penalty has been re-introduced. Given this, and the fact that the weekend penalty rates section in the Award states the penalty is 150%, we believe there is an error in the FWC schedule. The Award is due to be officially published on 18 June 2020, this may provide further clarity why there is a discrepancy.

Other changes include:

  • The year in the Award name has changed from 2010 to 2020. It is now called the Health Professionals and Support Services Award 2020.
  • The Pay Rate Schedule has been updated to reflect the new 2020 version of the Award. Some rates of pay may have changed by one or two cents.
  • A new clause which highlights which employment conditions in the Award may be varied by mutual agreement with an individual employee or a majority of employees.
  • The FWC has reinforced that employees who earn above the award minimum rate must be paid this higher rate when taking annual leave.
  • The FWC has clarified when overtime applies for part-time and casual employees.
  • Saturday, Sunday, and Shiftwork ‘loadings’ are now known as ‘penalty rates’.
  • The FWC confirmed that not all entitlements can be pro-rated for part-time employees. The entire weekly allowance must be paid to the employee regardless of their employment status (e.g. part-time). For example, the tool allowance of $11.45 per week must be paid in full when a chef or cook must supply their own tools. This particular change applies from 29 May 2020.

 

What Do I Need To Do?

  • Check your rates of pay to ensure you are meeting your minimum pay obligations.
  • If you have employees who are paid a salary and are not on an Employsure generated contract, it is recommended that you review the remuneration clause to ensure it specifically states that penalty rates are incorporated as part of that salary. If it doesn’t, Employsure recommends that you get in touch with a workplace relations expert to better understand the changes.
  • If you wish to vary any Award terms, Employsure recommends that you get in touch with a workplace relations expert before you do.
  • If you pay above the award, you should continue to pay employees their above-award rate when they take paid annual leave.
  • If you engage part-time employees, review the allowances they are paid to ensure you are meeting your minimum pay obligations.
