Further time off in lieu update.
We recently sent you updates regarding changes to the time off in lieu (TOIL) provisions in certain Modern Awards.
The most recent set of changes published by the Fair Work Commission (FWC) have incorporated the model TOIL clause into a further eight Modern Awards (click here for our previous update on these changes).
Gas Industry Award 2010.
The FWC recently announced a change to the Gas Industry Award 2010. The change incorporates a new clause that entitles employees to an allowance of 26% of the standard rate when they are required to be on availability duty. Availability duty is when an employee is continuously available outside normal working hours to attend to urgent or emergency situations and when they are paged or called, they must respond immediately.
The new clause also provides that if an employee who is on availability duty is unavailable when they are requested to attend an urgent or emergency situation, they will not be paid the allowance for that day.
Changes to some Queensland apprentice and trainee rates.
