  • Constitutional Corporation

    A trading or financial corporation under the Australian Constitution, or a foreign corporation – that is a corporation incorporated outside Australia that does business in Australia. To be a constitutional corporation, the corporation needs to be incorporated under the Federal Corporations Act 2001 or under other legislation, such as the WA Associations Incorporation Act 1987. Typically, businesses with a ‘Pty Ltd’ within its name are constitutional corporations.
