Defence officer dismissed over email porn is awarded compensation

A former Australian Defence Official that was sacked following a pornographic email scandal has been awarded 3 months’ worth of wages, following intervention by Fair Work Australia.

In 2012, the defence officer sent an email with a slide show of a naked woman to 15 colleagues. This behaviour was in clear breach of Defence policies and the pornographic material was considered demeaning of women.

The Defence department conducted a drawn out investigation starting with a quick assessment of the incident that determined a dismissal not necessary. Five months later, another investigation was carried out and then the officer was fired.

Fair Work Australia found that although the defence department was right to dismiss the South Australian based officer, his dismissal was harsh and unjust due to their poor process.

As a result, the officer was compensated with six months’ worth of wages that was reduced to three months, due to the nature of his behaviour.
