The Fair Work Commission has ordered a Bluescope Steel employee to be reinstated after finding that the investigation into his misconduct was poor and inconsistent with other employee incidents at the company.
The dismissal occurred after Duncan, being one of four employees with responsibility to check the batteries on a plant, failed to respond to an alarm about the battery temperature. Even though the other three employees did not respond to the alarm, Duncan was the only one issued with a warning letter about the incident and was later dismissed.
Consistency is key when disciplining employees.
