Changes to the Pharmacy Industry Award 2010.

The Fair Work Commission has made changes to the Pharmacy Industry Award 2010 (the Award), which come into effect from the first full pay period starting on or after 11 September 2017.

What are the changes?

  • Minimum engagement periods for school students (clause 12.2 and 13.5): employers may engage school students for a minimum of two hours (rather than three hours) between 3.00pm and 6.30pm on school days. The student and their parent/guardian must consent to this arrangement and the student must be supervised at work.
  • Junior rates of pay (clause 18): junior rates of pay have been removed for Pharmacy Assistants Levels 3 and 4. If you employee any junior employees classified as a level 3 or 4 Pharmacy Assistant, they will be entitled to receive the adult rate of pay.
  • Overtime payments (clause 26.1): Overtime payments (clause 26.1): minor amendments have been made to the Award to clarify some ambiguity over the payment of overtime and to confirm that casuals may be required to work reasonable overtime at overtime rates. An updated pay rate schedule will be available in your MyEmploysure Portal shortly.
  • Annualised salaries for Pharmacy Assistants Level 4 (clause 27): employers may now agree to annual salaries with employees classified as Pharmacy Assistant Level 4 (previously only possible with pharmacists). As with any annual salary, the employee must not be paid less than they would otherwise have received (eg with overtime, penalty rates etc) and a record of hours work must be kept (and countersigned by the employee). The Award also now requires employers to keep written copies of the agreement by employees to receive an annual salary – a option for an all-inclusive salary should be contained in the remuneration clause of your standard employment contracts. Please check the your relevant employee contracts and contact us if you require further assistance.

What do I need to do?

If you have any junior employees classified as a level 3 or 4 Pharmacy Assistant, you will need to ensure they are receiving at least the minimum adult rate of pay under the Award from the first full pay period starting on or after 11 September 2017.

An updated pay rate schedule will be available in your MyEmploysure Portal by Friday 8 September 2017. We will update you when this is available.
