Is your business planning on running on skeleton staff over the Christmas period or closing down?
Now is the time to start planning the specifics of your Christmas shutdown and to notify your staff accordingly. Many awards and agreements allow you to direct staff to take annual leave, or unpaid leave where annual leave has been exhausted, during a close down. There are however different requirements in each award about how much notice you need to provide and whether you can direct staff to take annual leave or unpaid leave. Some awards require 3 months’ notice of a close down.
Here are a few examples of how different the requirements can be.
Hair & Beauty Award – Requirement to provide four weeks’ notice of a close down. Employees can be directed to take annual leave. Employees can take unpaid leave if they have no annual leave balance.
Building and Construction General On- Site Award – Requirement to provide two months’ notice of a close down. Employees can be directed to take annual leave. Employees can take unpaid leave once all their accrued annual leave is exhausted.
Social Community, Home Care and Disability Services Industry Award – Employees cannot be directed to take annual leave during a close down. Employees can agree with their employer to take annual leave or unpaid leave during a close down.
