The Fair Work Commission has recently clarified the way some Award provisions apply, and made minor amendments to the Business Equipment Award 2020.
What Are the Changes?
Effective 18 June 2020, the Fair Work Commission (FWC) has clarified the way some Award provisions apply, and made minor amendments to the Award itself, including:
The year in the Award name has changed from 2010 to 2020. From tomorrow, it will be called the Business Equipment Award 2020.
A new clause has been added which highlights which employment conditions in the Award may be varied by mutual agreement with an individual employee or a majority of employees.
The FWC has clarified that a full-time employee works an average of 38 hours a week.
There are certain parts of the Award that don’t apply to clerical employees who are paid a salary that is 10% or more above the Award. The FWC have clarified which sections of the Award do apply to these types of employees, including but not limited to, consultation about changes to rosters or hours of work, dispute resolution and termination of employment.
Commercial travellers are now bound by the provisions under the Award for flexible working arrangements. Therefore, there are additional obligations which apply if you have an employee who is classified as a commercial traveller and they request flexible working arrangements
What Do I Need To Do?
If you wish to vary any Award terms, Employsure recommends that you get in touch with a workplace relations expert before you do.
