The Fair Work Commission has recently clarified the way some Award provisions apply, and made minor amendments to the Surveying Award itself.
What Are the Changes?
The Fair Work Commission has reinforced that employees who earn above the minimum award rate must be paid this higher rate when taking annual leave. Therefore you should continue to pay employees their ordinary rate of pay when they take paid annual leave.
You can now come to an individual agreement with an employee about the substitution of a public holiday.
You now must seek approval from the majority of permanent employees in the workplace or section of the workplace to change rostered days off.
What Do I Need to Do?
Ensure that you pay your employee their ordinary rate of pay during a period of paid annual leave.
Ensure that you consult with your employees to vary award provisions, as per the facilitative provisions.
